By accessing or using Anakto at www.anakto-iq.com or related services (the "Service"), you agree to these Terms of Service ("Terms"). If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

Anakto provides software that helps businesses detect missed calls, create leads and conversations, and send SMS follow-up messages. Features may change over time as we improve the platform.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate account information and to notify us promptly of any unauthorized use of your account.

You agree not to use the Service to:

• Violate any applicable law or regulation
• Send unlawful, deceptive, abusive, or spam messages
• Harass, threaten, or harm others
• Infringe intellectual property or privacy rights
• Attempt to disrupt, probe, or gain unauthorized access to the Service
• Use the Service for purposes unrelated to legitimate business communication

We may suspend or terminate access if we reasonably believe your use violates these Terms or creates risk for Anakto, carriers, or other users.

If you use Anakto to send SMS messages, you are solely responsible for obtaining and documenting appropriate consent from recipients, honoring opt-out requests, maintaining do-not-contact lists, and complying with applicable laws and carrier rules, including A2P/10DLC registration requirements where applicable. Anakto provides tools to support business communication but does not guarantee message delivery or regulatory approval.

You retain ownership of the business and customer data you submit to the Service. You grant Anakto a limited license to host, process, and transmit that data as needed to provide and improve the Service.

We strive to keep Anakto available and reliable, but the Service is provided on an "as is" and "as available" basis. Planned maintenance, third-party outages, carrier issues, and other events may cause interruptions or delays. We do not guarantee uninterrupted or error-free operation.

If paid plans are offered, pricing and billing terms will be presented at the time of purchase or in a separate order form. Failure to pay applicable fees may result in suspension of the Service.

To the fullest extent permitted by law, Anakto disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Anakto will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid to Anakto for the Service in the twelve (12) months before the event giving rise to the claim, or one hundred U.S. dollars (USD $100) if no fees were paid.

You agree to indemnify and hold harmless Anakto from claims, damages, and expenses arising from your use of the Service, your messages or content, or your violation of these Terms or applicable law.

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if continued provision of the Service becomes impractical. Sections that by their nature should survive termination will survive.

We may update these Terms from time to time. If changes are material, we will provide notice by updating the date at the top of this page. Continued use after changes become effective constitutes acceptance.

These Terms are governed by the laws of the United States and the State of Georgia, without regard to conflict-of-law principles, except where prohibited by applicable law.
